Editorial: Don't give online child solicitors legal loopholes

Some folks call it entrapment. They argue a man or woman should not face legal charges for transmitting obscene materials to what he or she believes is a child if the recipient on the other end is actually an undercover officer.

Last week, the Alabama Court of Criminal Appeals ruled that such actions are indeed a crime.

Undercover patrol cars comb our highways every day, issuing tickets to speeders and helping maintain highway safety.

Is the argument made that speeding tickets should not be issued by officers in undercover vehicles because the perpetrator believed the black Dodge Charger sitting in the median was just another motorist?

Undercover narcotics officers infiltrate the seedy underground society often occupied by drug dealers, pose as potential buyers, then catch the dealers red-handed.

Is the argument made that drug distribution charges should not be levied because the pusher believed the officer posing as a buyer was just another junkie?

Undercover vice squad officers pose as prostitutes on many street corners in this nation. A person wanting to spend what they perceive as quality time with the prostitute makes an offer, presents the cash, and finds out the hard way the call girl has a badge.

Is the argument made that solicitation charges should not exist because the person being solicited was a police officer and not a prostitute?

If such arguments are made, then society has a major problem within itself.

When a man or woman solicits what they believe is a child online, when it is in fact an undercover officer, there’s a grey area which triggered the loophole and room for argument. They were soliciting adults.

But don’t make us believe online predators — some of whom use the Internet to meet children — actually believe the recipients of their graphic material or requests to get together at a park are anything but kids.

That argument is out of whack and disturbing.

As evidenced by the countless murders and molestation cases of children we see and hear in the news, there are a ton of sick people in the world.

Loopholes to continue their craft should have never been explored.
