30-year-old man found guilty of burglary, attempted rape

A Lee County jury returned a guilty verdict Thursday afternoon, convicting Antonio Nixon, 30, of first-degree burglary and attempted rape.

Nixon’s conviction came in connection with an incident on July 3, 2008 at the Huntington Hills subdivision of Phenix City.

“Nixon knocked on the door of the victim’s residence asking for a particular individual,” said Lee County Assistant District Attorney Kisha Allen Abercrombie. “When the victim told Nixon the person he was asking for did not live there, he asked once more for the same person and as the victim began to try and shut the door of the residence, Nixon forced his way inside.”

Once inside the home, Nixon attacked and tried to rape the victim, Abercrombie said.

The victim sustained broken ribs and several lacerations to her face, with one injury to her forehead requiring 14 stitches, District Attorney Nick Abbett said.

At the time of the attack the victim, who managed to fight off her attacker, was at home alone with her 10-day-old child.

Nixon fled after the attack, but through information the victim provided the Lee County Sheriff’s Office, a description was quickly generated and an arrest made less than a week later, Abbett said.

“I think the women of Lee County are a little bit safer after today’s verdict,” Abbett said.

Chief Trial Assistant District Attorney Robert T. Treese agreed.

“The victim demonstrated extraordinary courage in taking the stand in this case,” Treese said.

Nixon will be sentenced at 3:30 p.m. Aug. 18 at the Lee County Justice Center.

AUfootball09,if you knew the whole case,then you would know that there was DNA under her finger nails, that didn’t match Mr. Nixon. Just because “President” Obama is in the white house doesn’t mean racsism doesn’t exist.  If you don’t believe me then just simply ask the black kids in PA when they were asked to leave because they changed the complexion of the pool, but these kids paid their money just as everyone else did.  So we can’t say that racsim is over. Sorry for getting back to you so late!

The only thing that matters in a court of law, is the verdict rendered by the jury.  Not the opinion of family, friends, or the cousin of the brother of his kindergarten teacher’s sister’s husband.  That does not matter. 
What most of you don’t understand is that a jury is more likely to acquit a guilty man than find an innocent man guilty.  That is because of the burden of proof.  If the defendant is able to put forth a possible alternative to the crime then the jury must acquit.  That is why OJ got off (and the prosecution was horrible).  A victim’s word is definitely enough to convict.  There is not always physical evidence.  Like I said, put down the remote.  You must also realize that ALL 12 people on the jury said he was guilty.  A consensus must be reached for a guilty verdict.  That means, those 12 people new beyond a shadow of a doubt that Nixon did it.  No matter the race of the juror (covered later).
As far as the jury of his own peers, no it is not people that look like him, or think like him.  The system was not designed that way.  As far as the jury selection process goes, it is very complicated.  It turns out to be 12 people, that live in Lee County, 18 years old or older, registered to vote, that each attorney thinks will benefit them. 
Racial profiling? Come on now…  I thought all race cards were null and void when Obama took office.  PROOVING there is no racism in America.  I did not vote for Obama, not because of the color of his skin, but I do not agree with his policies.  Actually, he got voted in because of reverse racism (yes there is such a thing).  Everyone wanted to see history made, at the cost of our future.  I wish we could following Dr. King’s words and judge a person NOT on the color of their skin but the content of their character.  That includes reverse racism….

AUfootball09: You seems to have all the answers and you are quick to judge. What is a jury of your peers? Is it people that look and think like you because if it is this was not a jury of his peers. Lets not forget that people are in jail as we speak that has been wrongly convicted. So when you condem a person please please make sure you don’t live in a glasshouse. My prayers goes out to both side.

Due to the critiquing of comments, please analyze the truth of the matter. Racial profiling did and still exists in today’s society. I am a family friend of Antonio Nixon. I have known him for the past eight years. He is a hard worker, family oriented and a role model to young men. I am a CSI viewer but I have common sense and God’s knowledge to understand that this trial is full of lies. We should all be able to examine the evidence that has been presented and realize the following: Traces of blood, DNA, etc. should have been discovered to point Mr. Nixon to this crime. The victim words alone should not be the determination of a guilty verdict. As a woman, if a stranger appeared at my home, I would utilize common sense and my best judgment not to open the door. Mr. Nixon did not present a weapon to sway or assault his way in. I feel that women do not possess enough strength to overpower a man. Most importantly, the timeframe that the victim states the incident occurred in doesn’t have value. Therefore, I must go out on a limb and state whether anyone have questioned the possibility that the victim husband committed this crime and NOT MR. NIXON. Of course, this makes sense. However, the conviction of Mr. Nixon DOESN’T. He is not O.J. Simpson. Mr. Nixon is an innocent man. I pray that the truth is revealed soon. To the jurors, I pray that you soon realize that you have made the wrong decision. Unfortunately, a good, honest, and peaceful man will have to deal with this for a long time. To the Nixon family, my heart and prayers are with the each of you. Keep your head up, stand tall, be strong, and know that God is with you.

Please Please Please do not insult this man’s family.  Let he without sin cast the first stone.  We as Americans know how this justice system works.  Nothing has changed regardless of who the President of the United States is at the moment.  Everyone one including the KKK is entitled to their opinion.  We all know what opinions are like so please lets just let this rest.  To the family of the Defendant, I pray that you find peace in knowing that God has not forsaken Mr. Nixon.  This is his test.  This is his story. This is his TESTIMONY.  Also, to the Victim and her family.  Not long ago it was acceptable to look outside of a situation for scapegoats, Domestic Violence is REAL and has a long history, it does not pause, or go away silently.  Lives have been changed forever, I pray that you are READY.

Family: If you continue to write, please write like you have a 4th grade education.  The mixture of captial and lower case letters makes your posts difficult to read.  The grammar mistakes I can handle.  Now, because you have police officers in your family does not mean YOU know how it works.  Intelligence is not genetic.  Did you not go to the trail?  Did she ever take the stand?  If not, why didn’t she?  Every defendant has a right to face his accuser.  If she was not heard at trial it is apparent that her testimony would have been even more damaging.  Thus, logically, make him more guilty.  Just because he is in your family doesn’t make him innocent.  This is a cruel and hateful world we live in, and hateful people are often a lot closer than we think…

Family: I never claimed to know him, and I have never said he did it.  I was not “judging him,“ because this has already been done.  He was found guilty.  If you were familiar with court proceedings and the way law enforcment works, you would know that they can’t arrest or bring charges without EVIDENCE!  Evidence means there proof showing he was there and committed the crime, and the jury found that he was guilty beyond a reasonable doubt.  Therefore, I don’t have to judge. All I am saying, is that good people can go bad.  Just because you were brought up in a good home, means NOTHING!  This man was convicted by a jury of his peers, thus he will be punished accordingly…
