State troopers stymied in attempts to raid casinos

SHORTER — Hundreds of state police were stymied Friday in attempts to raid two multimillion-dollar bingo operations in Alabama as lawyers scrambled to block the seizure of thousands of electronic bingo machines.
Both the VictoryLand complex at Shorter and the Country Crossing development in Dothan shut down before dawn as state troopers and other law officers converged with blue lights flashing.
However, a Tallapoosa County District judge issued an order at 5:30 a.m. Friday blocking any raid at VictoryLand in Macon County until a hearing can be held next week. The bingo center, with more than 6,400 machines, reopened as the caravan of troopers drove off, along with nine moving vans brought to haul away machines. The facility has 10,000 more machines in a nearby warehouse.
At Country Crossing near Dothan, some 140 troopers and law officers gathered at the entrance for a raid at the new country-themed entertainment complex, which has about 1,700 electronic bingo machines. The number of officers dwindled to about 15 as lawyers for the casino argued that no raid could be conducted without a warrant or legal authorization.
``We’ve told them they are trespassing. We’ve told them to leave,‘’ said Country Crossing spokesman Jay Walker.
However, troopers and trucks remain near the property in case the Supreme Court reverses the order today.
The head of the governor’s antigambling task force, Mobile District Attorney John Tyson Jr., went to Montgomery to ask the Alabama Supreme Court to lift the order blocking the raid at VictoryLand and to appoint a new judge to approve a search warrant to raid Country Crossing.
It was not immediately clear when the Supreme Court might act.
Tyson was the focus of a press conference Friday morning on the steps of the state capitol.
“In VictoryLand’s instance, we have been temporarily stymied by issuance of the temporary restraining order by Judge (Thomas F.) Young at the Tallapoosa County Courthouse. What we find interesting about that order is that it was just two weeks ago that the Alabama Supreme Court rendered a decision that clearly indicated which civil courts do not have jurisdiction to interfere with the administration of the criminal justice system.“
Tyson said Conecuh County District Judge Jeff Brock declined to grant a search warrant for Country Crossing until he heard from a gambling expert. The judge later said no proceeding with the expert would take place before Monday, prompting Tyson to ask the high court for another judge.
The casinos have been operating under constitutional amendments that allow bingo in those counties. But Gov. Bob Riley contends those amendments — and 15 others that allow bingo halls to operate in other counties — allow only traditional paper bingo, not electronic machines that resemble slots. Slot machines are illegal in Alabama.
Tyson warned electronic bingo operators across the state: ``Obey the law. Shut down these machines.‘’
Fred Gray, an attorney for VictoryLand, said the Macon County operation has been investigated by a federal grand jury and two county grand juries, with no charges ever filed.
He said there was no legal justification to seize property.
``They had no warrant, they had no court order, and presented nothing to the owners,‘’ Gray said.
Macon County Sheriff David Warren said the task force tried to stage the 4 a.m. raid by arguing an undercover officer witnessed illegal gambling inside. Warren disagreed, however.
``As far as I’m concerned they are legal machines,‘’ he said.
At a news conference in Montgomery, Tyson said no search warrant was needed because an undercover officer inside VictoryLand witnessed an illegal gambling device, a misdemeanor, that would allow a raid and seizure of the machines.
VictoryLand owner Milton McGregor cut the ribbon in December on a 300-room luxury hotel at the complex in Shorter, about 20 miles east of Montgomery on Interstate 85. The hotel and additions are a $100 million investment in a gambling complex that began with a dog track 25 years ago.
VictoryLand now holds more of the bingo machines than the number of slot machines in any single casino in Nevada, New Jersey or Mississippi, according to Casino City’s North American Gaming Almanac. It employs about 2,000 people in a historically poor county.
Country Crossing in the southeast corner of the state opened its $87 million first phase on Dec. 1, with more attractions this year pushing the total investment to more than $200 million.
The governor’s task force attempted to raid Country Crossing in pre-dawn hours Jan. 6, but a judge’s order blocked that. The Alabama Supreme Court later shelved that order, and another judge took the case this week.
The task force previously had been unable to get a search warrant to raid VictoryLand in Macon County.
Last year it conducted a raid at the White Hall casino in Lowndes County, seizing about 100 of the 900 machines and more than $500,000 in cash. The case is in court, and the casino has been operating with new equipment.
In Macon County, former state Sen. George Clay of Tuskegee said VictoryLand is the county’s largest employer and taxpayer and is vital to the county’s operation. He said the attempted raid was reminiscent of a former governor’s attempt to preserve racial segregation in the mostly black county.
``Fifty years ago, George Wallace sent state troopers to prevent the desegregation of our schools,‘’ he said. ``Now Bob Riley has sent state troopers to shut down our economic engine.‘’

golfer64. i myself seem difference in meth labs and bingo to see a casinos. meth has teenagers and folks out here getting high, steeling from folks. causing accidents and even killing people just to get another hit. i havent heard of people leaving the trackand doing the stuff these meth heads are doing. you are one of those people who doesnt like the bingo facilities so no-one should.If you dont like those places, dont go to them. And if these places are so illegal why have they sold them buissness license for all these years now? Why have they sold building permits to make them bigger to add more machines? Why has riley waited 8 years are longer to bring this situation up. Sounds to me someone must have cut his commission, or he wanted more and couldnt get it. You seem to know alot about it so tell me and everyone else why the state would rather pay all those people unemployment than let them work and actually earn thier pay with the economy being the way it is right now. they need to shut riley down and send him home for wasting all the state money he went through with this so called raid that didnt do anything to justify his actions in macon county.

I look at it this way just because a meth lab employs someone that doesnt mean we shouldnt break it up because of that and this is just like that but on a much much larger scale and it is being masked as legal because all of the quote unquote donations. bamaman, I couldn’t agree more. Ram, said it perfectly, you can’t legislate morality. Yes, some believe that gambling is immoral. Some say that while standing that those very machines on the weekends. I personally gamble very rarely (might go to GA and buy a ticket tree or four times a year). I am not about to point a finger at anyone who chooses to do so. I looked at WSFA’s poll on the issue and 76% of the people voting on their site agree with the majority on this thread. Riley! LEAVE IT ALONE!!!!! Save the money for job creation and retention!!!!
The point is iif people wanna play the games, they will. wheather its alabama or another state like mississippi. So why not keep the money and the jobs here in Alabama. Im sure the local state and goverment is getting thier share. Same thing goes for the lottery, look at the folk who drive to Ga. and Fla. just to play the lottery. Its just amazing how some folks dont want Alabama to Have any progress moving foward. Just something else the the govenor and some others to have all the say so. Basically anything people want to do and might enjoy, the goberment has got to have all control. Like oh no you might be enjoying that so you cant do it anymore or make any money at it. People against the bingo playing, thats real simple why not just stay away and quit complaining because you dont agree with them.

I’m pretty sure that there is a major difference between pulling a handle on a machine hoping that money comes out, and purchasing a share of ownership in a publicly traded company. Not trying to be rude, but I don’t think that’s a very good comparison. The stock market can be a valuable tool to increase one’s net worth if studied and used properly. Pulling a lever with high hopes of “striking it rich” is a very failed system of earning anything, a system where the house always, always, always wins and has the advantage. The various stock indices historically perform well, and at decent margins of profit. I don’t think that they should be compared to gambling.
I have said it before and I’ll say it again.
Playing the stock market and playing the lottery/slot machines are the same.
You are placing money on the markets/ placing money on the tables in hopes of increasing your profits.

Allow the people of Alabama to decide what is best for themselves… I believe that is what we call freedom on choice, governor!
Alabama needs a common sense and practical minded person to be the next governor of this state. We have the people and the resources, we just need someone with a little horse sense so to speak, to do what needs to be done.
I say pick a county like Coosa County, build the largest casino(s), I’m talking the Las Vagas of the South! Build roads in from I-65 and U.S. 280. Sure it would also take a transparent oversight agency to regulate and tax it, but that could easily be funded by gamgling taxes.
FACT IS, as I have stated many times, a government can not legistlate morarility. There are people who do whatever, everyday, even if it’s speeding!
I know I am dreaming, but great things have began with just a thought and dream!
It’s time to have something that can fund the state agencies and other needs such as schools, healhtcare, elderly assistance and many more.
I realize this is not the “Christian” thing to do, but as a former pastor of mine said often, “people are going to do what they want to do”. I have found this to be true…

You know, Ram, I voted for him too, twice. I so regret it and it has become overwhelmingly apparent that he is merely a self serving self absorbed greedy politician and I had so hoped he wasn’t. It seems you can’t swing a cat these days without hitting one. Increasing sin taxes such as you and I have been discussing for the Bingo halls to cover education, health care, and job creation and other programs that only benefit our state, seems pretty cool. I really think a lot of people would back it. Bingo/gambling, cigarettes, alcohol . . . are not necessities, they are recreation and can be life threatening/altering and addictive. A high tax on them could help detour some from trying that life style and encourage others to seek help if they are experiencing a disruption in their happiness due to their using and indulgence. It won’t keep me from having a fru-fru blender drink every blue moon while hanging out with the girls at Chili’s or a Samuel Adams Ale while watching SEC football and the Superbowl (yes, I’m a chick who likes a good beer every now and again). I’ll pay the extra, as I’m sure everyone many would, especially when the benefit goes to our state. We are one of the poorest states, we have one of the highest infant mortality rates, and we’re fortunate here in the eastern part as we fund ours well, but much of the state suffers from underfunding and poor resources for the state’s public schools, i.e. not enough books for students and falling apart school buildings. It’s time to bring this state to life and make this an example of New South Way of Thinking. Being resourceful and having our citizens benefit from it. Riley has let us down. He’s got a chip on his shoulder now and has totally lost sight on the prize, our state’s future. Make some jobs, Bob, educate our children, Bob, and make sure grandma gets the medical services she deserves, Bob! And STOP beating a dead horse with this raiding Bingo Halls with our tax money pouring out of your pockets, when there are much bigger fish to fry, Bob!
I KNOW one thing for sure, Bob Riley should have his mind and efforts on jobs and the economy than fooling with this stuff…I wish I could recind my vote for him in the last election.
I have watched and listened to Riley and state rep. DuWayne Bridges do stupid stuff here lately that does not have a thing to do with helping unemployed Alabamians and other more pressing issues.
Say bye DuWayne, you WILL be voted out this year! You can concentrate on ripping people off at your truck stop & boot outlet!
