Auburn University running back Eric Smith has filed charges of harassment against the Auburn student he allegedly assaulted outside a local hotel, the Opelika-Auburn News has learned.
Arrangements have been made for Decari Jenkins to surrender to Auburn police in the wake of Smith’s charges, assistant police chief Tommy Dawson said. Jenkins will be processed just like Smith was early last week, when he turned himself in two days after Jenkins accused him of 3rd-degree assault.
“Now it’s going to be for the court to decide,“ Dawson said.
Smith is due in court Nov. 5, where he could face up to a year in jail and no more than a $6,000 fine if convicted of the Class A misdemeanor. Dawson said another court date will be set for the allegations against Jenkins, but the two cases could very well be settled at the same time.
Smith’s allegations are not as severe as Jenkins’.
Harassment is considered a Class C misdemeanor and is punishable of not more than three months in prison, according to Alabama Code.
According to Section 13A-11-8 of Alabama’s code of law, the crime applies if a person “strikes, shoves, kicks, or otherwise touches a person or subjects him or her to physical contact; uses abusive or obscene language or makes an obscene gesture towards another person. Harassment shall include a threat, verbal or non-verbal, made with the intent to carry out the threat that would cause a reasonable person who is the target of the threat to fear for his or her safety,“ the law states.
After arriving at the Lexington Hotel in response to a call about a fight, police officers witnessed Smith, 19, strike Jenkins in the back of the head, which knocked Jenkins unconscious, according to a complete report obtained by the Opelika-Auburn News. Smith was arrested for disorderly conduct at 1:42 a.m., Aug. 21, and transported to the Lee County Detention Center. He was sober and did not resist arrest.
Jenkins was taken by ambulance to East Alabama Medical Center, where he was treated for his injuries. Jenkins suffered a cut and “severe swelling around his eye,” according to the report.
A warrant was issued for Smith’s arrest later that afternoon after Jenkins filed a report alleging that Smith assaulted him.
Smith told officers at the scene that Jenkins punched him in the nose earlier in the night, according to the report. Smith “did appear to have blood coming from his nose at the time of the incident,” the police report says.
In the new report, Smith is alleging that he was harassed sometime between 1:15 a.m. and 1:30 a.m. Smith, who was also treated for injuries, did not know Jenkins, according to the report.
Smith, a bulky sophomore tailback who ran for 83 yards in 2008, has not been with the team since the incident. Auburn coach Gene Chizik has refused to offer any timeline for a potential return.

We here at The AUBlog aren’t allowed to gamble on college football because of a thing called “ethics.“ It pains us so, because we sure do love the action.
There is nothing against encouraging the masses to throw a little money down, though.
This weekend, your Auburn Tigers are anywhere from 13-14 point favorites over Louisiana Tech, depending where you look. For those in the know, this should entice some action.
We’re not saying Auburn is going to lose this game. When we make our pick for Saturday’s tailgater, we’re going with (spoiler alert) Gene Chizik snapping his 10-game losing streak and earning his first-ever victory in the orange and blue. But do we think the Tigers are going to cruise? Not exactly. Auburn certainly has the talent edge, but Louisiana Tech is coming off a strong, 6-6 season and has beaten an SEC team on the road before. OK, so it was Mississippi State, but that’s still something, especially from a team that was still in the rebuilding process. Also, we’ve heard a lot about this Gus Malzahn offense (look for more in Wednesday’s Opelika-Auburn News) but this will be its first test. And we also remember the Tony Franklin offense.
A few more facts: Auburn went just 2-9 against the spread last season, good for last among SEC teams. Since 1992, the Tigers are 23-22 when picked as a favorite of 10.5 to 21 points, according to theSpread.com. Overall, Auburn is 57-63 against the spread since 1992.
More pertinently, the Tigers are 2-2 against the spread in games with Louisiana Tech since 1992.
ALSO…We recently visited Sin City and saw that the over/under for Auburn wins this season is 7.5. That struck as a bit surprising, but then we saw the payouts. If you pick under, it’s (-250) and if you go with the over, it’s (+180). For those smart enough not to be addicted to gambling, that means Vegas is making it much more enticing to bet the over because eight or more wins would be viewed as a major success and, to some, a major surprise. Basically, the ratios work out that if you bet the under, you have to pay $250 to win $100. For the over, if you bet $100, you win $180.

The Tigers don’t have one of those things in their locker room, but they might as well.
Players who entered and exited the Rane Room on Sunday were noticeably upbeat. They gave great answers, smiled for the cameras and joked around a bunch.
They say it’s because Saturday’s game is only five days away. We think it was because they only have to deal with us media types one more time this week.

Tigers excited that season opener only around the corner
Throughout Sunday’s practice and even when he debriefed the team at the end, Gene Chizik wasn’t ready to admit that the Tigers were noticeably upbeat simply because “game week” had commenced.
“He said maybe the weather helped a little bit,” tight end Tommy Trott said.
Afterward, though, Chizik was more than able to divulge the obvious truth.
“The guys had a little bit more of a bounce in their step as you would imagine,” Chizik said. “It was a good day but the thing that stood out most was I thought they had a lot of energy.”
After nine months of turnover, workouts and uncertainty, the ticker on the top of the wall in Auburn’s locker room showed that the Tigers have just five more days to prepare for Saturday’s season opener against Louisiana Tech.
It’s been a long time coming.
“Just looking at that, it’s real close,” Trott said. “It’s a lot different than the summer when the thing says 160-some days. So it’s right around the corner.”
The Tigers will treat this week like the rest to come, practicing Tuesday, Wednesday and Thursday with an off-day today and walk-throughs on Friday. Friday night will be spent out of town, so the team can “get away from all the distractions,” Chizik said.
Because Auburn has had almost a month to prepare for the Bulldogs, though, there will be a few quirks unique to this week only.
“It is a little bit different, because we’ve been able to piecemeal some Louisiana Tech time before today, which we pretty much fully devoted to them,” Chizik said. “So we don’t feel like all of the practice we’ve had, we don’t feel like we’re in a real game-week scenario yet, so we’ll try to taper off and get our legs back under us yet before Friday.”
Fannin gets another new role
Chizik said to expect an official depth chart in the coming days, but Mario Fannin eliminated one of the spots of intrigue Sunday.
Fannin said he will be returning punts Saturday.
“It’s going to be fun,” Fannin said. “I think it’s going to actually enhance my game more as far as focusing and being tuned into the game. It will help me make wiser decisions when it comes to other things on the field.”
Fannin, a junior, has never returned a punt in a college game. In fact, he’s only returned one punt during his entire football career.
He took it back for a touchdown.
“It’s been a learning experience,” Fannin said. “Now, the ball is travelling higher and you have faster guys running down the field towards you. It’s mainly just focusing on the ball and making the right decision.”
Fannin said he was also in the mix to be one of the Tigers’ kick returners. Terrell Zachery, Onterio McCalebb and Harry Adams have also been candidates, he said.
Phillips still out
The status of freshman offensive lineman Aubrey Phillips, who has been out the majority of the preseason after an “unspecified medical episode,” remains a mystery.
Chizik said that Phillips was “doing better” and has been participating in team meetings.
Immediately after Phillips transferred from Florida State in July, it was expected that Auburn would petition the NCAA for him to be eligible this season. Chizik said Sunday he had yet to hear if Phillips would be eligible if he’s healthy enough to play.
Goggans back at end
Michael Goggans move to defensive tackle was apparently a short-lived experiment.
Fellow end Antonio Coleman said Goggans had moved back to his former position and was working with the first-team defense.
Goggans, along with newcomers Nick Fairley and Nosa Eguae, had been “cross-training” throughout the preseason.
